Car finance

How to check if a car has outstanding finance

Most cars in the UK are bought on finance. With the most common kinds, the car belongs to the finance company, not the driver, until the last payment is made. Buy one with money still owing and you could find yourself dealing with the lender.

In short

  • With hire purchase (HP) and PCP, the finance company owns the car until it's paid off.
  • A seller who still owes money can't simply sell the car as their own.
  • The V5C logbook doesn't prove who owns a car. It shows the registered keeper.
  • Check before you pay. If finance shows up, make sure it's settled before you hand over any money.

Which kinds of finance stay with the car?

TypeWho owns the car?
Hire purchase (HP)The finance company, until the final payment.
PCPThe finance company, unless the driver pays the final “balloon” payment to keep it.
Leasing / contract hireAlways the leasing company. The driver never owns it, so can never sell it.
Personal loanThe driver. The loan isn't tied to the car, so it doesn't affect who owns it.

Why the V5C logbook isn't enough

The V5C shows the registered keeper: the person responsible for taxing and insuring the car. It says on the document itself that it isn't proof of ownership. A car can be on finance with the seller's name on the logbook, so the logbook alone can't tell you whether money is owed.

What happens if you buy a car with outstanding finance?

The finance company may try to recover the car or the money owed. If you're a private buyer who bought in good faith without knowing about the finance, the law (Part III of the Hire Purchase Act 1964) generally protects you and you keep the car. But:

It's far easier to check first than to argue later.

What to do if a check shows finance

Outstanding finance isn't automatically a deal-breaker. People sell cars they're still paying for all the time. It just has to be paid off properly:

  1. Ask the seller about it. An honest seller will usually already know and have a plan.
  2. Ask for a settlement letter from the finance company showing exactly how much is owed.
  3. Make sure the finance is paid off before or as part of the sale, for example by paying the settlement figure directly to the finance company, with only the balance going to the seller.
  4. Get written confirmation from the finance company that the agreement is settled.
  5. Check again before you collect the car.
Walk away if the seller won't let you speak to the finance company, pressures you to pay cash quickly, or says the finance “will be cleared later”.

How to check a car for outstanding finance

Finance companies register their agreements against the car on industry databases. You can't search them directly, but a vehicle history check does. The Your Car Data full history check shows any outstanding finance recorded against the car and, where provided, the finance company, the type of agreement and when it started, plus stolen, write-off and mileage checks in the same report.
